    Dear Editor,
    July 10th, 2007 Will be a day of flowers showered all over USCIS office from thousands and thousands of legal immigrants all around US. This day, we express our pain and frustration that has been carrier by us since 5-9 years. This is going to be a peaceful protest with millions of flowers delivered to USCIS Director, Emilio Gonzalez.
    Gandhi ji is not alive, but many gandhians are born in our heart and soul, to make USCIS realise the value of Hardship and humanity.



    This is probably the first time when skilled, legal professionals are participating in an event like this at this scale and it goes to show the level of anxiety in the community right now. Would you be willing to write about this event ?

    Hi guys,
    My first H1B (2003) had LUD on 14th of July...and today there is a LUD on I-140. My I-140 approved in March 2007..PD is March 2005...Is it good indication that they are doing something with my I-485 case? My application reached NSC on july 2nd (not sure about time as my lawyer sent those papers). My I-140 is from TSC.


    Today i added my old H1B (2003) case to my portfolio..i saw LUD on it...LUD date is '14th july 2007'...not sure...14th july is saturday...but no surprise...i saw lot of people posted that their LUD was on weekends....Is it good indication? sorry if i am asking unnecessary question..

    ok, start predicting the april visa bulletin and cheer up. everyone has problems and most are depressed. i have been victim of severe depression, i cant even say, most of the time it has so severe effects -- i lose my appetite. but i dont cry in public, nor say publicly i suffer from it, nor have i been to a doctor for it.

    Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

    I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.

    SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.

    The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

    Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

    We also came here in early 99. One of our friend came 98 and renewed ead 3 times. One of my husband's colleague is here since 95. My husband's coworker s from his first/second employers who came during same time are close to get citizenship. If my husband wouldn't have switched his jobs for his carrier advancements and salary then we also would have applied for citizenship by now. But we don't regret our decision at all. We feel sad sometimes but depressed by not getting GC by now, instead we spend that energy in advancement of our skills and carrier. We have many people among our friend circle who are waiting for GC for many years but we decided to enjoy our life as much as we can and not to bring any GC related depression in our life. If you have such friends among you then it becomes very easy to get out of this depression.

    Finally we have decided to go back to India for good. I filed my EB3 in May 2003. Its going to be another 4 years to get the green card. When I went to India for vacation last December, we liked it over there & the economy is booming. There are all sorts of discussion regarding the Economic Gap/Politics/Corruption/Cleanliness. But we like it over there. Finally I will have an option to do something interesting. In US I was very much dependent on my monthly pay check and afraid to take even the slightest risk. I am also scared to use the AC21(Hey, thats the way I am). I am working with the same company for last 10 years, kinda stagnant in the last 4 years. In India, there are lots of choices, either to work for a sw company or start some business on my own. I think I will take the business route.

    May be I can go there, earn well, send my son to US for college, do green card through him & come retire in US!!!

    Good decision. I was opposed to going back but I think its good to do just that. You see lot of folks going back after getting their citizenship.

    I know you don't want us to use paypal - but I think that might be delaying lot of contributions.

    Here is my case - I have a very hectic work schedule -so by the time I go home I forget to write and send a check. If I could do paypal then would be no problem as I can do from any where - work - from phone - anywhere.

    Just a thought.. I have been planning to send $50 or so but kept on forgetting. Don't get me wrong but telling the truth here.

    My Wife's & my AP expires on 11/16/2008 and she is coming back to the States from India on Sep 9th 2008, I'm assuming her I94 would be only issued till 11/16/2008. We are then planning to apply for EAD/AP renewal , that is, after Sep 9th 2008 and my question is what is she doesn't get her renewed AP approved before 11/16/2007 (which again I'm assuming would be the date on I94 valifity) and would that make her out of status? I hope this helps

    H1B quotas for 2001, 2002 and 2003 were 195000. Three times the norm. This could be the reason they quotas were not met during those years. Sure market conditions also helped.

    I thinks EB3 INDIA will move between 9/11/2001 to JAN 2004 , because after 9/11 probably few people applied for GreenCrd because of market condition, even h1b quotas are not used for 2002 and 2003, i applied for h1b on 2004 April , no surprise the quota available because of market condition.

    Actually You have to PHYSICALLY present in Canda for 2 years in a 5 year period since the date landed.

    You have to PHYSICALLY present in Canda for 3 years in a 5 year period since the date your became PR.

    I had a LUD on 7/28 and nothing after that... My I140 approved in Texas in April2006. I think we should get the receipt number here pretty soon...


    Why do you have this hunch?
    It seems like all the LUDs on approved I140 from Texas for July filers is pointing towards their I485 being sent to Texas too. Hence, this unimaginable prolonged delay. Can we do anything about it except sulk?

    Let it run its course.

    It is indeed ugly and disgusting that anyone who talks of doing good to EB3 ends up getting reds. IV should remember that EB3 members outnumber EB2's by a vast margin and they deserve to get justice too

    And it is not as if EB3's are less qualified. Most are as much or more qualified and experienced than EB2's. It is just an accident they are in EB3, as companies put them there when there was no difference in USCIS policy between the two

    If I continue to see the treatment meted out to EB3's in these forums I would take the decision to quit IV..

    I am starting this new thread to discuss about EB visas spillover usage based on oldest priority date irrespective of category/country. Currently the spillover happens vertically(a top down approach) from EB1 -> EB2 -> EB3...etc. Instead it should be first used on cases with oldest priority date. This will not only give a good move to clear the backlog but will also be a fair rule for those who are patiently waiting in queue for a long time. I wrote my concern about this to my local congressman. I also request each one of you, who is impacted by this, or who is interested to help us out, to kindly contact your local congressman/woman to express your concern. In turn they can contact USCIS to implement this fair rule to help us all out.

    If this idea is implemented, a Pulitzer or Oscar or Olympic Medal winner(let us say in 2010) will have to wait until all backlog before his/her PD is cleared.
